Tradie Lady Hire – Terms and Conditions

About Our Platform

Tradie Lady Hire (‘we’, ‘us’, ‘platform’) is a platform owned by Tradie Lady Club Pty Ltd, seeking to overcome historical barriers for women, and connecting clients with female tradespeople, with a view to addressing the underrepresentation of women in trades. This is a special measure, having in mind empowering women in trades and making connections with female-owned businesses.

We match clients to suitable female tradies across multiple trades and industries, and share their contact details to enable them to make employment and contract arrangements directly between themselves. Tradie Lady Hire does not manage arrangements or payments between clients and tradie ladies, and are not involved in further organisation beyond facilitating the initial match between clients and tradie ladies. Tradies and clients are generally matched by trade and location.

Subscription and Fee Structure

For Tradeswomen:

  • $39.99 per month, including two free leads
  • $10 per additional lead

For Homeowners (one-off jobs):

Free to post jobs and hire female tradies.

For Businesses (long-term employment packages):

  • $350 for one trade type (you will receive 3 contacts) for that one trade type
  • $450 for 5 contacts for one trade type
  • $650 for 7 contacts of the same trade type. If more tradies apply to this beyond the package they paid for the client has the option to purchase an extra contact for an extra $100 per additional trade contact beyond that.

For Apprentices and Long-Term Listings:

  • A one-off $50 fee allows apprentices to list their profiles for employers to find them.
  • Fully qualified tradies who want to be listed for long-term employment also pay a one-off $50 fee.

Refund Policy for Business Packages

If a business purchases a package to hire a tradie for long-term employment or an apprenticeship and are not successful in finding someone through our service within three months, we will provide a 90% refund if:

  • In relation to a 3 contact package, if no more than one contact applies
  • In relation to a 5 contact package, no more than three contacts apply
  • In relation to a 7 contact package, no more than four contacts apply

Details of applications will be recorded on our platform and our clients will be able to see these in their profile.

All payments are nonrefundable and there are no refunds or credits for partially used packages, unless otherwise required by law, or provided for in these Terms.

Verification and Liability

We take reasonable steps to verify tradies’ licences and ABNs but do not take responsibility for work quality or payment issues, and do not participate in resolving any disputes that may arise. We, through our platform, simply provide the initial connection between tradies and clients and others who are seeking to connect with tradies.

The Tradie Lady platform enables users to create detailed profiles with their identification, ABN, and enables website upload, creation of a bio, and the ability for users to provide written reviews.

Terms and Conditions of Use

These Terms and Conditions of Use form part of the Terms and Conditions (‘Terms’) of Tradie Lady Hire. All aspects, components, intellectual property (including but not limited to copyright and trade marks), content and user-generated content, designs, text, graphics, images, information, software, audio and other files and their arrangement (‘Content’), embodied in, available through, or used on our platform are proprietary to, or licensed to, Tradie Lady Hire (‘Tradie Lady’).

Tradie Lady does not grant or provide you with the right or license to reproduce or otherwise use, copy, republish, download, display, modify, distribute, frame, post, transmit, or sell in any form or by any means, in whole or in part, any Content, other than as expressly permitted in these Terms.

Tradie Lady offers, in good faith, a platform to facilitate you connecting with people who may provide, or may require, services of tradies (‘Services’). You acknowledge that you are bound by these Terms, from when you first use our platform. By using the platform, you assign to Tradie Lady any and all rights, title, and interest, including any intellectual property rights or proprietary rights, in the Content generated by you. All rights of Tradie Lady or its licensors that are not expressly granted in these Terms are reserved to Tradie Lady and its licensors.

Tradie Lady grants you, the user, a limited, non-transferable, non-exclusive licence to download, install and use one copy of the platform for personal, non-commercial purposes in object code form only on an interactive wireless device that you own or control. The Provider and its licensors own and shall retain all intellectual property rights and other rights in and to the platform, and any changes, modifications, or corrections to it. You may not derive or attempt to derive the source code of all or any portion, or permit any third party to so do.

User Obligations

In connection with registering for and using the Services, you agree to:

  • Provide accurate, current and complete information about you and/or your organisation as requested by Tradie Lady;
  • Be fully responsible for all use of your account and for any actions that take place through your account;
  • Maintain and promptly update any registration information you provide, to keep such information accurate, current and complete; and
  • Maintain the confidentiality of your password and other information related to the security of your account.

You warrant that your access to the platform and use of the Services will be in accordance with these Terms and with all applicable laws, regulations and rules of the State of Victoria, and any other relevant jurisdiction, including those regarding online conduct, and those regarding the transmission of data or information. You further represent and warrant that you have created or own any material or Content you submit via the platform and that you have the right, as applicable, to use that material and to grant the permissions referenced in these Terms.

Content Licence

You hereby grant to Tradie Lady a fully paid, royalty free, perpetual, irrevocable, worldwide, nonexclusive, transferable, and sublicensable license to use, copy, reproduce, adapt, modify, distribute, merge, publicly display, and create derivative works from, any Content you might provide during your use of the platform from time to time, and to incorporate it into other works, and sublicense the Content.

You acknowledge that this licence cannot be terminated by you once your Content is submitted. You represent that you own or have secured all legal rights necessary for any content submitted by you to be used by you, Tradie Lady, and others as described or contemplated in these Terms. You understand that other users will have access to your content and that neither they nor Tradie Lady have any obligation to you or anyone else to maintain the confidentiality of it.

Acknowledgements and Agreements

You acknowledge and agree that:

  1. Transactions are handled directly between users of the platform, not through Tradie Lady Hire;
  2. A review/appeal feature will address inappropriate or unfair reviews and images;
  3. You will not misuse the Service, infringe any intellectual property rights of Tradie Lady, or introduce malicious code, upload, display or otherwise provide Content that is libelous, defamatory, abusive, harassing, threatening, hateful, offensive, or otherwise violates any law or infringes upon any right of any third party (including intellectual property, privacy, or other right, whether personal or proprietary), or which in Tradie Lady’s sole judgment, is objectionable, or restricts any other person from using the platform, or may expose Tradie Lady or any user of the platform to any harm or liability of any kind;
  4. Tradie Lady:
    1. Will not be liable in any way in respect of any disputes or liabilities arising from reviews, ratings, or job site issues, or from your use of third-party content or links;
    2. Can terminate your account for breach of these Terms;
    3. Can change its annual subscription fee from time to time, to apply at your next renewal and/or as notified;
    4. Does not warrant that the material contained in the platform or your access to it will be uninterrupted or free of viruses or similar, or make any representation regarding accessibility in respect of the platform or materials on it, and will not be liable for damage or loss resulting from any delay in operation of any kind, virus or similar, communications failure, access difficulties or malfunction, however caused; and
    5. May, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Services, temporarily or permanently.

Advertising

The Tradie Lady platform may include advertisements, which may be targeted to the Content or information on the platform, or other information. The types and extent of advertising are subject to change. In consideration for Tradie Lady granting you access to and use of the platform, you agree that Tradie Lady and its third-party providers and partners may place such advertising in connection with the display of Content or information submitted by you or others.

Third-Party Links

The platform may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Tradie Lady, and we do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third-party website, service, or content, you understand that these Terms and any other legal requirement do not apply to your use of such sites. You expressly acknowledge and agree that Tradie Lady shall not be responsible or liable, directly or indirectly, for any damage or loss whatsoever, arising from your use of any third-party website, service, or content.

Limitation of Liability

To the maximum extent permitted by law, Tradie Lady does not give any guarantee, warranty, condition or representation in relation to the platform or Services, and you agree that by using Tradie Lady, you are bound by these Terms, and agree and acknowledge that Tradie Lady will not be liable for, and you indemnify it and its directors, officers, employees, contractors, agents, suppliers, licensors, successors and assigns, in relation to any, direct, indirect, special or consequential losses, or other losses of whatsoever nature or however such loss may arise, and by whomever it may be sustained, including any loss of profit, loss of opportunity, or economic or financial loss in relation to your use of the platform, any Services, including, to avoid any doubt, in relation to the performance, conduct, competence, suitability or longevity of any person or contractor, tradie, or potential contractor or tradie, or any principal, entity or body, as the case may be, made known to you or with whom you connect, or deal with, through Tradie Lady.

You are responsible for all decisions relating to hire, and any obligations you assume as a counterparty to any arrangement or legal relations you enter into with any person or entity in connection with your use of the platform.

In the event that any guarantee, warranty, condition or representation applies at law, to the extent permitted by law, Tradie Lady’s maximum liability in respect of all claims, actions, demands, proceedings, liabilities, damages, amounts, costs and expenses paid, suffered or incurred by you (directly or indirectly) as a result of or in connection with any act or omission of Tradie Lady, including any outage or interruption in service, or any breach or non-performance of any express or implied obligation or otherwise is limited to the amount paid by you for the Services.

Payments

All financial transactions made in connection with use of the platform will be processed by a third party in accordance with their terms of use, privacy policy, and/or any applicable payment terms and conditions. Tradie Lady will not be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or service outages.

Disclaimer

The service provided to you via this platform is offered on an ‘as is’ basis and, to the extent permitted by law, Tradie Lady makes no representations or warranties of any kind with respect thereto, either express or implied, and you acknowledge that all such representations, including those in relation to fitness for purpose, merchantability or the like, are all expressly disclaimed. Without limiting the generality of that, Tradie Lady makes no representation or warranty in relation to accuracy, service availability, completeness, information or Content, error-free operation, or results to be obtained from use.

Termination

Tradie Lady may terminate your access to and use of the platform immediately at any time, for any reason, and at such time you will have no further right to use the platform. You may terminate your account at any time by following the available instructions.

General

  1. If any provision of these Terms is found to be invalid or unenforceable by a court of law, such terms will be severed, and the remaining terms will not be affected and will continue to be in force. Any rights not expressly attributed in these Terms are expressly reserved.
  2. These Terms contain the entire agreement between the parties about its subject matter. Any previous understanding, agreement, representation or warranty in relation to that subject matter is merged with these Terms and has no further effect.
  3. These Terms are governed by the laws in force in Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the Courts of Victoria and Courts of Appeal from them.
